[2010-03-23] Court Action against delinquent taxpayer

New Media Communications Ltd and its Principal Director Desmond Richards were taken before theTax Court on Monday, March 22, 2010 for breaches of the Income Tax, Education Tax, General Consumption Tax Acts. The ongoing tax matters were brought before the Sutton Street Court by the tax authorities after all attempts to arrive at a settlement agreement failed.

At the hearing, Attorney for the taxpayers, Mr. K. Dabdoub requested time to make suitable payment arrangements. This was denied by Resident Magistrate Owen Parkin, who indicated that the taxpayer had been given more than enough time by the Inland Revenue Department to do so. The Court then ordered that the outstanding principal sums of $35,559,577 for GCT and $58,332 for Income Tax, relating to years 2000 - 2003, be paid in six (6) monthly instalments. This order takes effect on April  29, 2010. If the taxpayer defaults on the court order, more drastic action will be taken.

In the criminal matters relating to PAYE and Education Tax, the company and the director were each summoned to answer to 136 offences brought before the Court by the tax authorities, resulting from failure to pay Income Tax and Education Tax for the period 2003 - 2008. These matters are scheduledfor sentencing on April 29, 2010, when the taxpayers will again be brought before the Court.

New Media Communications Ltd, which produced the Sunday Herald and its managing director, were first summoned to appear before the Court on March 3, 2009. Since then the taxpayers have made seven (7) court appearances with little headway made in settling the outstanding liabilities.
